Boston – Federal prosecutors are moving to compel former Boston City Councilor Tania Fernandes Anderson to pay a $13,000 forfeiture following her conviction related to a City Hall kickback scheme. The motion, submitted in federal court by U.S. Attorney Leah Foley, indicates that the government may seize Fernandes Anderson’s assets equal to the amount if she does not make the restitution payment agreed upon in her plea deal.

Fernandes Anderson, who pleaded guilty on May 5, 2025, to two felony charges of wire fraud and theft concerning a federal program, was implicated in misconduct involving a $13,000 bonus awarded to a family member on her staff. The arrangement entailed a kickback, in which Fernandes Anderson demanded $7,000 be returned to her. This illicit exchange took place in a City Hall bathroom in June 2023 and was coordinated through text messages.

U.S. Attorney Foley stated that the forfeiture order could be enforced regardless of Fernandes Anderson’s financial status at the time of her conviction, allowing for potential future asset seizures. As a result of her guilty plea, four additional wire fraud charges were dropped. Furthermore, she faced a possible $5,000 fine for a related state ethics violation for hiring immediate family members and providing them with raises and bonuses.

In her role as a city councilor, Fernandes Anderson had a salary of $120,000 and represented District 7, which includes neighborhoods such as Roxbury, Dorchester, Fenway, and part of the South End. She resigned her position on July 4, 2025, after initially resisting calls for her resignation following her indictment. The timing of her resignation means there will be a vacancy in the Boston City Council until a new District 7 councilor is elected in November.

Sentencing for Fernandes Anderson is set for July 29, where U.S. Attorney Foley has recommended a prison sentence of one year and one day in addition to the restitution payment. A federal judge overseeing the case has indicated that Fernandes Anderson could receive an even harsher sentence than the one proposed by the prosecution. The maximum punishment for wire fraud can extend to 20 years in prison and a fine of up to $250,000, whereas theft concerning federal funds can carry a penalty of up to 10 years.

This recent legal turmoil follows Fernandes Anderson’s historic election to the City Council in January 2022, where she became the first Muslim American, African immigrant, and formerly undocumented individual to hold the position. Her arrest in December 2024 on six charges of public corruption sparked immediate backlash, leading multiple city officials, including Mayor Michelle Wu and five city councilors, to call for her resignation.

Following her resignation, the City Council convened its first meeting without Fernandes Anderson, and she issued an apology to her constituents. Despite the circumstances, she expressed a desire to ensure a smooth transition for her district’s leadership until the end of her term. The legal proceedings moving forward will serve as a significant chapter in the ongoing discussion around ethics and accountability in public office.
