The Suffolk District Attorney, Kevin Hayden, is making headlines by appealing a Boston Municipal Court Judge’s recent dismissal of charges against a man who found himself detained by ICE during his trial.
The drama began when Judge Mark Summerville found ICE agent Brian Sullivan in contempt of court. This was in response to Sullivan’s arrest of Wilson Martell-Lebron—who is also known by the name Juan Carlos Baez, a Dominican national—right outside the courthouse on the first day of his jury trial. The judge felt that by detaining Martell-Lebron, Sullivan was interfering with the court’s proceedings.
Summerville didn’t mince words when he dismissed Martell-Lebron’s case. He cited “egregious prosecutorial misconduct” from the prosecution team as a reason, leading to a subsequent finding of contempt against the ICE agent. This created a cascade of responses as the contempt findings have now been sent to the Suffolk DA’s Office to consider prosecution against Sullivan.

He claims that the contempt finding violates the Supremacy Clause of the U.S. Constitution, which recognizes federal law as the supreme law of the land.
