The U.S. Supreme Court has rejected a legal challenge against the Vineyard Wind project, ending ACK For Whales’ efforts to halt the offshore wind farm development. The court’s decision follows a series of lower court rulings favoring the project, which aims to power 400,000 homes. Despite concerns over its environmental impact on the North Atlantic right whale, the project has resumed construction, emphasizing the ongoing debate between renewable energy development and environmental protection.
Nantucket, Massachusetts – The U.S. Supreme Court has declined to hear a legal challenge against the Vineyard Wind project, effectively ending the efforts of ACK For Whales, a Nantucket-based nonprofit, to impede or delay the development of the offshore wind farm. The decision comes after ACK For Whales claimed that the project poses a threat to the critically endangered North Atlantic right whale and alleged that the U.S. Department of the Interior violated federal regulations in its approval process.
The Vineyard Wind project is expected to supply power to around 400,000 homes upon completion. However, ACK For Whales argued that the project’s impact on marine life was not properly assessed, citing violations of the Outer Continental Shelf Lands Act, Endangered Species Act, and National Environmental Policy Act.
Previously, the U.S. District Court for the District of Massachusetts had granted summary judgment in October 2023, dismissing the organization’s case. Following this ruling, ACK For Whales sought to elevate the matter to the Supreme Court after facing defeats in the lower courts. However, the Supreme Court, which accepts approximately only 2% of the 7,000 cases presented each year, ultimately decided not to take on the challenge, thus solidifying the previous court rulings.
Despite the setback, ACK For Whales expressed disappointment but acknowledged the slim chances of their case being accepted by the Supreme Court. The group plans to continue its opposition to offshore wind development by filing two Notices of Intent to sue regarding another project named New England Wind, which they claim poses an “existential threat” to the environment.
The legal struggle over Vineyard Wind has spanned multiple levels of the judiciary. An initial appeal to the First Circuit of the U.S. Court of Appeals sought to overturn a May 2023 ruling by U.S. District Court Judge Indira Talwani, which upheld the project’s permit. The First Circuit dismissed the appeal in April 2024, confirming that federal agencies adhered to legal protocols while evaluating the potential effects of the wind farm on the right whale population.
In the wake of the Supreme Court’s decision, Vineyard Wind has resumed construction activities that had been temporarily halted due to a blade failure incident in July 2024. By late December 2024, all 62 monopile foundations for the wind farm were successfully installed. Currently, the project continues to be under construction, with modified federal orders allowing some aspects of work to resume, but it remains restricted from generating power at this time.
Looking ahead, the completion of the Vineyard Wind project is expected to contribute significantly to renewable energy efforts in the region. Advocates of wind energy stress the importance of transitioning to sustainable sources to address climate change, while organizations like ACK For Whales underscore the importance of environmental protections and the need for thorough impact assessments for new developments.
