BOSTON, Mass. — A 24-year-old Hyde Park man was arrested on gun charges early Friday after Boston police officers who stopped to check on a smoke-filled rental car found a loaded revolver tucked in his hoodie, the department said.
Officers from District B-3 were patrolling near Delhi Street at about 1:16 a.m. when they noticed a rental vehicle idling with two people inside and heavy smoke pouring out of its windows. Walking up, they saw both occupants smoking marijuana and spotted an inspection sticker that looked questionable. The officers told the driver he could not smoke marijuana while operating a car and asked both men for identification.
After more questions, police ordered both men out. Officers said the passenger resisted, leaning back farther into the seat, before they assisted him out of the car. A pat frisk turned up a hard metal object at his waist, and officers pulled a gun from the front pocket of his hoodie. A records check showed he had no license to carry.
District detectives came to the scene and processed the gun, a Charter Arms Corp. revolver. It had five .38 SPL rounds in it. The man is due in Dorchester District Court to be arraigned on charges of carrying a loaded firearm without a license and possessing ammunition without a firearms identification card.
Unlicensed gun possession is among the most heavily punished weapons offenses in Massachusetts. Under state law, a conviction for carrying a firearm without a license brings a sentence that cannot be cut below 18 months, and the person is barred from probation or parole until that minimum is served. The law allows a state prison term of two and one-half to five years, or a county jail sentence of 18 months up to 30 months. Neither charge has been proven in court.
